In fact, they are primarily essential to review the status of title and give their advice upon the title of an immovable property. Even if after all this, you still believe that a lawyer is not necessary during the course of negotiations, do keep in mind that there may be last-minute disputes about delivery of possession and personal property or the adjustment of multiple costs, and if you are the only person without a lawyer, your rights may be infringed.

When should you approach a lawyer for real estate?

A lawyer may be approached at any given time, while dealing with real estate. This is because, throughout the course of a real estate transaction, there exists a risk of legal issues. A real estate lawyer can help solve legal issues and establish the client’s rights. You may approach a legal counsel for mere advise before even entering a real estate transaction, or at any time while buying a property, entering purchase/sale/lease/development agreements, for title search or even during the closing, which is the most important step in the purchase and sale transaction.

What is Due Diligence in real estate?

Caveat emptor, which translates to let the buyer beware, is a fundamental principle in commerce and contractual relationships between a buyer and a seller wherein the burden of due diligence is placed on the purchaser/buyer. Due diligence in terms of real estate transactions mainly deal with ascertaining the veracity of the ownership title of the seller, the encumbrances over the property (if any), the transferability of the property and the related conditions, etc.

It is a common saying that “no one can transfer a better title than he himself has”. Thus, to receive proper title over the property, it shall be ensured that the person selling it does not have a defective title. To determine the same a process called investigation of title is carried out by real estate lawyers.
